I concur. Illegals by definition should not be granted ANY rights. Show proof of citizenship upon entering ANY er/hospital. If it is a state law to treat them, we need to change this. it’s harsh but needs to be done.

Ms. Lambeth,
While it is a federal law, so is the Affordable Care Act and Texas has already taken steps to not follow it so why should this be any different?

In short, the constitutional challenges against EMTALA failed, as it is only a directive for hospitals that participate in Medicare, whereas the ACA imposes a individual mandate. The ACA has been and continues to be challenged in courts by numerous states, mostly based on federal overreach into state sovereignty.
