In the event of an arrest of a CHL holder (any class of misdemeanor charges); I believe we should make extra effort to have confiscated legal weapons & equipment (knives, holsters, magazines, et.al.) returned posthaste to said individuals in the event such charges are dropped or successfully defended against.
Presumably, the State & Federal background checks have done their job; and as such, the CHL holder should be considered less of a security risk than those that have not had such checks.
I propose return of such items – inclusive of the CHL License – to be made in a 48 hr timeframe! If Law Enforcement can confiscate such items in less than an hour’s time – returns within 48 hrs is MORE than generous! Our ponderous legal system needs to be freed of such low-priority nonsense, and the good guys should be assumed to be a non-issue in the eyes of that system – should they be found to be such.
In short: It’s OUR stuff, NOT their’s – and we want it back YESTERDAY!

I agree with your idea, “innocent till proven guilty” is the backbone of our civil liberties. I had 2 guns stolen from house 7 years ago. The teenage boy was quickly caught with them at a party. A year after he was arrested, I finally got my 2 pistols back. I was not only a victim of the boy but the legal system as well.

I moved to Texas from GA only to find Texas has far more restrictive laws placed on law abiding gun owners. Open carry is illegal in Texas, campus carry is illegal in Texas, and Texas requires law abiding citizens who possess a concealed carry permit to submit to being disarmed and searched by any cop for any reason without suspicion of any wrong doing….simply because I have a permit.

Police should not be using the ‘stop and disarm’ law to harass the tiny percentage of law abiding Texans who have a permit, they should be focusing on the criminals who could care less about permits and who carry and use guns illegally.

The law should favor law abiding gun owners instead of giving police the right to treat them like criminals.

Funny how many states allow open carry and there are no problems but Texas has banned it because the mere sight of a law abiding gun owner exercising their right is somehow “scary” and “offensive”. Ive lives in Georgia, North Carolina, Utah, and Texas…and Texas has the most restrictive gun laws for law abiding citizens out of all these states. Even in California, a person with a CCW permit can carry on campus concealed.
