As the mother of a Primordial Dwarf, I’m aware that many Little People must either climb on counters or be picked up in order to properly wash their hands. The ADA currently doesn’t offer any guidance that allows businesses to know that 1) accommodations need to be made and 2) how to accommodate. The ADA currently has guidelines for accommodating other groups of needs, however, those guidelines are too broad and prevent the opportunity for Little People to be accommodated with regards to properly accessing sinks in restrooms. Businesses are afraid to accommodate Little People because they’re too afraid of being sued due to the broad guidelines already in ADA regulations. The ADA needs more clearly defined bathroom guidelines and guidelines need to be added for accommodating Little People. Little People deserve accommodations, too.

    Ms. Bernal,

Thank you for this response. You present a very interesting issue.

Is there any legislation that would allow the ADA to better address the concerns of persons with primordial dwarfism?

How can the State of Texas contribute to this discussion?

Many business with whom I’ve spoken agree that there is a need of which they weren’t aware, yet know they need to address. However, they’re finding that current ADA regulations for wheelchair access in the restrooms are so open-ended that it disallows them the opportunity to provide accommodations for other groups’ needs for fear of being sued. The State could provide regulations that would either more clearly define what’s listed in the ADA or it could provide official recommendations that would allow proper access for both wheelchairs and Little People. It would not only help Primordial Dwarfs, it would help ALL Little People. The Little People of America endorses my efforts and we’re both interested in being able to find a way to provide access for all.
